Agreement
Trading Smart X is operated by BraveBinary LLC, 28771 La Siena, Laguna Niguel, CA 92677, United States ("BraveBinary", "we", "us"). These terms apply to the website tradingsmartx.com and to the Trading Smart X app at app.tradingsmartx.com (together, the "Service"). By using the Service you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.
You must be at least 18 years old and able to enter a binding contract to use the app.
The service
Trading Smart X is an AI-assisted options research tool. It analyzes market data and can suggest trade ideas within limits you set. The app is in private beta: features may change, be limited or stop, and we may end access to the beta at any time.
Not investment advice
- The Service is for research and education only. Nothing in it is investment, legal or tax advice, or a recommendation to buy or sell any security.
- BraveBinary is not a broker-dealer or a registered investment adviser.
- Options trading involves substantial risk and is not suitable for every investor. You can lose more than you invest. Past or simulated results don't guarantee future results.
- Market data may be delayed, incomplete or wrong. You are solely responsible for your trading decisions and for checking information before you act on it.
Your account
- Give accurate information and keep it up to date.
- Keep your password and sign-in methods (authenticator app, phone, passkeys) secure. You are responsible for activity on your account.
- Tell us right away at [email protected] if you think someone else has used it.
- We may suspend or close an account that breaks these terms or puts the Service or other users at risk.
Text messages (SMS)
Program: Trading Smart X sign-in codes. When you add a phone number as a sign-in method in the app and select Send code, you agree to receive one-time passcodes by text message from Trading Smart X at that number.
- What we send: only security codes, for example "Your Trading Smart X sign-in code is 123456." No marketing or promotional messages.
- How often: one message each time you sign in with text message codes, set up this method or reset your password. Frequency varies with how often you sign in.
- Cost: message and data rates may apply, set by your mobile carrier.
- Opt out: reply STOP to any message. You'll receive one confirmation and no further texts. You can also remove the phone number in the app under Account → Security. After opting out, use another sign-in method. Reply START to opt back in.
- Help: reply HELP or email [email protected].
- Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and coverage.
- Privacy: we use your phone number only to send these codes. We don't sell it, and we don't share mobile phone numbers or text message opt-in data with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
Acceptable use
Don't:
- break the law, or use the Service to manipulate markets or mislead others;
- try to get into accounts or systems you aren't allowed into, or test, probe or overload the Service;
- scrape, copy, resell or redistribute the Service, its data or its analysis, except as these terms allow;
- reverse-engineer the Service, or use it to build a competing product.
Intellectual property
The Service, its software, design and content belong to BraveBinary or its licensors. We give you a personal, non-transferable right to use the Service under these terms. Market data comes from third-party providers and is subject to their terms.
Third-party services
The Service may connect to third-party services, such as a brokerage, Google sign-in or data providers. Their own terms apply, and we aren't responsible for them.
Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, accuracy and uninterrupted operation.
To the extent the law allows, BraveBinary is not liable for indirect, incidental, special, consequential or punitive damages, or for trading losses or lost profits, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.
You agree to indemnify BraveBinary against claims arising from your misuse of the Service or your breach of these terms.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Orange County, California.
Changes to these terms
We may update these terms. We'll change the date at the top and, for significant changes, tell account holders by email or in the app. Using the Service after a change means you accept the new terms.
